2014 CASES:

$775,000 settlement for construction accident for 47-year-old electrician who claimed that he fell from an inadequate make-shift ramp consisting of two wooden planks that were not fastened together or otherwise secured. Our client suffered back injury with herniated disks which required spinal epidural injections.

2013 CASES:

$1.775 million settlement for catastrophic injury for 56-year-old elevator mechanic who was injured while performing an elevator repair at the defendant's apartment building. Our client was using the aluminum ladder that was given to him by the building's maintenance staff to climb up from the elevator pit; and the ladder, which was cracked and broken, slipped and fell, causing him to fall several feet. He sustained a trimalleolar fracture of the left ankle with a severely comminuted and displaced intraarticular pilon fracture which required multiple surgical procedures, including open reduction and internal fixations.

$1.5 million settlement for construction accident for 40-year-old electrician who slipped and fell on ice on a construction project. Our client injured his back and neck, which required surgery, although the defendants argued that his injuries were pre-existing.

$1.3 million settlement for construction accident for 55-year-old electrician who fell from the 4th step of a ladder that broke with resulting herniated disc at L5-S1 of the lumbrosacral spine (low back), as well as internal derangement of the cervical spine (neck) and left shoulder.

$750,000 settlement for construction accident for 51-year-old electrician who was caused to fall down a flight of stairs when a temporary handrail snapped. Our client suffered injuries to his neck (cervical spine), upper back (thoracic spine) and left shoulder with rotator cuff tear. (The defendants claimed that the injuries were pre-existing.)

$750,000 settlement for construction accident for construction accident for 49-year-old electrician who was caused to slip and fall while walking on a wooden ramp that was covered with snow and slush, with resulting left shoulder injury with rotator cuff tear that required arthroscopic surgery.

$435,000 settlement for construction accident for 48-year-old electrician who was struck by a wheel barrow being pushed by a concrete worker, with resulting knee injury.

$400,000 settlement (after successful jury trial on liability) for construction accident for a 30-year-old window service technician who injured his ankle and shoulder when he tripped while descending a defective scaffold in the course of repairing a window at a renovation project for a private residence.

2012 CASES:

$6.2 million settlement for medical malpractice for 49-year old woman who underwent relatively routine abdominal surgery for subtotal colectomy with ileosigmoidostomy for recurrent diverticulitis. During this procedure she developed a volvulus of the small intestine which effectively cut off the blood supply to the small intestine and caused the distal 2/3's to become unviable. This necessitated the removal of most of her small intestine with resulting short gut syndrome which required combined small intestine and pancreas transplant.

$2.5 million settlement for construction accident for 40-year old electrician with a history of prior neck and back injuries, who slipped on a small patch of ice on a construction site with injuries to his neck and lower back, resulting in cervical fusion and implant of lumbar spinal stimulator.

$850,000 settlement for construction accident for 25-year old apprentice electrician who suffered knee injury when he fell from closed, unsecured A-frame ladder that slipped out from underneath him. Our client, who had prior history of anterior cruciate ligament (ACL) injury with prior surgery sustained recurrent ACL tear and medial meniscal tear that required arthroscopic surgery for ACL reconstruction and medical meniscal repair.

$500,000 settlement for construction accident for 50-year old electrician with prior history of right wrist injury, who slipped and fell on snowy, slushy ramp on construction site, with resulting scapholunate tear of right wrist that required surgery, including proximal corpectomy with posterior interosseous neurectomy and subsequent arthrodesis (fusion).

$425,000 settlement for construction accident for 40-year old electrician who was performing asbestos abatement and removal of existing electrical system as part of a demolition/gut renovation project. While attempting to removal copper detail/bus bar that was supposed to have been taken out of service, he received severe electrical shock from backfeed that caused him to fall from 6-foot A-frame ladder with resulting left shoulder injury with superior labral anterior posterior (SLAP) tear that required arthroscopic surgical repair.

2011 CASES:

$4 million settlement for construction accident for 30-year old elevator mechanic's helper who suffered electric shock while working "live" on elevator modernization project, with resulting injuries to his left shoulder, back and neck, as well as neuropsychiatric and emotional disorders.

$4 million settlement for medical malpractice for 47-year old woman who underwent significant, but uneventful abdominal surgery; but she suffered stroke with hemiparesis when hospital incorrectly placed triple-lumen catheter in her carotid artery rather than her jugular vein.

$2.7 million settlement for construction accident for 28-year old apprentice electrician who was struck in the head by a cement-filled shovel that was accidentally dropped from a higher floor of the job site. Our client (who thankfully was wearing a hard-hat) suffered neck injuries including a compression fracture of the C-5 vertebra and cervical disc herniations. He also suffered a severe psychiatric reaction, including depression and post-traumatic stress disorder.

$1.4 million settlement for motor vehicle accident for 49-year old pedestrian who was struck by a vehicle that disobeyed red traffic signal, struck another vehicle and struck our client. Our client suffered injuries to her cervical spine, lumbar spine, knee and ankle, as well as post-traumatic stress disorder, anxiety and depression.

$725,000.00 settlement for premises liability for 60-year old woman who slipped on slippery, waxed floor in basement of apartment building where she lived, and suffered comminuted fracture of the patella (knee cap) that required surgery. Although the building’s maintenance staff claimed that appropriate warning signs were in place, this was disputed by our client.

$400,000.00 settlement for medical malpractice for 29-year old woman who underwent prolonged labor with uterine atony due to delay in performing C-section, with resulting post-Cesarean hemorrhage that required supracervical hysterectomy.

2010 CASES:

Jury verdict in excess of $4 million for construction accident which resulted in $3.25 million settlement pursuant to "high/low" agreement, for 58-year old electrician who received electric shock while working on ladder, causing him to fall 20 feet and suffer fracture/dislocation of right ankle, with fracture of fibula and severely comminuted fracture of the tibial pilon, which required several surgical procedures.

$2.5 million settlement for construction accident for 42-year old electrician who was performing repair work on subway tunnel and tripped/slipped on debris on narrow catwalk, with resulting lumbosacral herniated disc which required surgery, including discectomy and spinal fusion, and with permanent left foot drop.

$1.9 million settlement for construction accident for 54-year old electrician who was injured when he tripped on masonite floor covering that was not properly taped down. Our client required surgery for injuries to his knee and wrist.

$1.85 million settlement for motor vehicle accident for 53-year old man who was a front-seat passenger in a van that struck a stopped dump truck in the rear. Our client instinctively reached out and placed his right hand on the dashboard in anticipation of the impending collision; and the van's airbag deployed on impact, with the airbag making direct contact with his hand. As a result, our client sustained open, segmental fractures of both the radius and ulna, requiring surgery with open reduction and internal fixation for this both-bone forearm fracture, with restriction of motion of the fingers and thumb of his right hand, and with resulting limited motion and pain of his right shoulder, with consequential adhesive capsulitis ("frozen shoulder"). Although our client was in a company van being driven by his co-worker, he was not precluded from suing his employer (the owner of the van) or his co-worker (the driver of the van) because he was in the process of being driven home after his work was completed, and he did not seek or receive workers compensation benefits.

$1.2 million settlement for construction accident for 56-year old electrician who was injured when he stepped into an uncovered 9 inch opening on a third floor catwalk. His left leg went into the opening up to his knee; and he injured his neck and lower back, with both cervical and lumbosacral radiculopathy requiring epidural injections, and also injured his shoulder (rotator cuff) and wrist (carpal tunnel syndrome), requiring surgery.

$1.05 million settlement for construction accident for 47-year old electrician who tripped/slipped on debris in hallway, with resulting aggravation of pre-existing arthritis of both hips requiring bilateral hip resurfacing surgical procedure.

$750,000 settlement for medical malpractice for 69-year old woman who suffered right foot drop due to peroneal nerve injury during hip replacement surgery.

$610,000 settlement for premises liability for 40-year old chef who tripped and fell while working in kitchen, with resulting injuries to his knee and lower back, requiring surgery.

$450,000 settlement for construction accident for 37-year old electrician who received electric shock which caused him to fall from a ladder, with resulting injury to right shoulder (torn rotator cuff requiring arthroscopic surgery) and neck (cervical radiculopathy requiring epidural injections).

$400,000 settlement for construction accident for 57 year old electrician who fell from ladder and suffered fracture of the right calcaneus (heel).

2009 CASES:

$2 Million settlement for construction accident for 42-year old electrician who tripped and fell on "stub-ups" (remnants of old conduits) at the bottom of the stairway, with resulting shoulder injury requiring surgery and herniated lumbar disc at L4-5.

$1.05 Million settlement for construction accident for 39-year old electrician who was knocked off her ladder by water when a nearby pipe burst with resulting shoulder impingement and lumbar radiculopathy.

$800,000.00 settlement for construction accident for 55-year old electrician who slipped on oil/grease on loading dock and suffered wrist injury requiring surgery, including right wrist scaphoid excision and limited intercarpal fusion.

$750,000.00 settlement for construction accident for 55-year old electrician who slipped and fell on empty water bottle that had been used by masons to wet the mortar, and suffered tears of the medial and lateral menisi of the right knee.

$600,000.00 settlement for municipal liability based on alleged police brutality, where victim was allegedly beaten and kicked by police officers and suffered ruptured bladder requiring surgery. Successful settlement obtained even though criminal prosecution of police officers by District Attorney resulted in acquittals.

2008 CASES:

$10.5 Million settlement (including interest) following $8.9 Million verdict (reduced to $7.6 Million on appeal) for construction accident for 31-year old electrician who was kneeling on wooden platform of Baker's scaffold that collapsed, and he fell 8 feet to the concrete floor below, with resulting comminuted fracture of his kneecap (patella) and tear of lateral meniscus. Our client required surgery with open reduction and internal fixation, a second operation to remove the hardware and for partial lateral meniscectomy, and a third operation for further partial lateral meniscectomy.

$3.1 Million settlement for construction accident for 40-year old electrician who was injured when he attempted to break the fall of his co-worker, who fell from a ladder. Our client sustained neck and shoulder injuries, with herniated discs at C4-5 and C5-6 that required cervical decompression and fusion, as well as surgery for partial rotator cuff tear.

$1.25 Million settlement during trial for construction accident for 40-year old sheet metal worker who was installing duct work to air conditioning unit that was installed the day before. The unit was improperly suspended and one side dropped about one foot and struck our client, who was working on a ladder. He was struck in the neck and shoulder and suffered herniated cervical discs and cervical radiculopathy, with rotator cuff injury and impingement (no surgery).

$900,000.00 settlement for construction accident for 42-year old electrician who slipped and fell on stairway that had dust on the steps because tapers had sanded the walls; and it was claimed that the handrail had been removed during renovation. He suffered torn rotator cuff that required surgery.

$750,000 settlement for construction accident for 40-year old laborer who was working on a sewer line installation project and was injured when an excavation collapsed on him, causing him to suffer left knee injury with fracture of tibial plateau and lateral condyle with tears of medial meniscus, lateral meniscus and anterior cruciate ligament, which required knee reconstruction surgery.

$550,000.00 settlement for construction accident for 41-year old electrician who fell from ladder when he passed out due to excessive heat, and suffered a fractured ankle that required surgery.

$550,000 settlement for construction accident for 46-year old electrician who was working on a ladder when the top step collapsed. He was able to grab another step to prevent himself from falling, but in doing so, he suffered bilateral rotator cuff tears which required surgery on both shoulders.

$550,000 settlement for construction accident for 35-year old electrician who fell through an inadequately protected floor opening to his thigh, with torn medial meniscus of the right knee that required arthroscopic surgery; and while he was convalescing at home, his knee gave out while he was walking down the stairs, with resulting injury to his shoulder that required surgery.

2007 CASES:

$4.9 Million settlement during trial for construction accident for 37-year old electrician who tripped and fell due to defective stairway, with low back injury including herniated disc at L5-S1. Despite arthroscopic surgery for the herniated disc, our client did not improve and his condition progressively worsened, severely restricting his ability to walk and stand for any length of time.

$2.5 Million settlement for construction accident for 38-year old female electrician (with history of prior neck injury) who tripped on uneven Masonite protective floor covering, and suffered neck injury with herniated discs requiring cervical fusion.

$1.5 Million settlement for construction accident for 34-year old electrician who was working on a ladder and was in the process of pulling wire and installing conduit when the ladder began to slide and he began to fall. To avoid falling, he grabbed onto the conduit and twisted his neck, resulting in herniated discs at C6-7 and C5-6 that required anterior cervical decompression and fusion surgery.

$500,000 settlement for construction accident for 49-year old electrician who tripped on an uneven floor where door saddle had been removed, with resulting injury to his right knee with aggravation of prior degenerative arthritis, with torn medial and lateral menisci requiring arthroscopic surgery.

$500,000 settlement for construction accident for 36-year old electrician with history of severe ulcerative colitis requiring 5 prior operations (including removal of colon) who slipped on oil that leaked from a machine and suffered ventral hernia requiring further surgery.

$450,000 settlement for construction accident for 63-year old electrician who was struck by falling debris that was being dropped without appropriate safeguards, with injuries to the right shoulder and both wrists. He required shoulder surgery for torn rotator cuff and had surgery on both wrists for carpal tunnel syndrome.

2006 CASES:

$3 Million settlement for medical malpractice for 48-year old man who underwent routine blood tests that showed moderately elevated PSA levels, which are an early sign of prostrate cancer. However, his physician failed to inform him and did nothing for 1-1/2 years until the PSA levels had doubled and the prostrate cancer had spread, thereby reducing his opportunity for a favorable outcome and requiring him to undergo radical prostatectomy, radiation and chemotherapy.

$2 Million settlement for construction accident for 37-year old electrician who tripped/slipped on partially coiled cable that was strewn on the floor in passageway on the job site near an elevator shaft. He grabbed a nearby safety railing to prevent himself from falling, but wrenched his shoulder, with torn rotator cuff and impingement, which required three operations.

$1.5 Million settlement for construction accident for 43-year old electrician who fell from ledge in PATH tunnel, with aggravation of prior neck and low back injuries, which involved herniated cervical discs at C5-6 and C6-7 and herniated lumbar discs at L3-4 and L4-5.

$750,000 settlement for municipal liability for 44-year old woman who slipped and fell on ice in front of courthouse, with fracture of her right ankle that required surgery with open reduction and internal fixation, and with shoulder injury.

$435,000 settlement for premises liability for 45-year old woman who was injured in laundry room of her apartment building when the bottom metal door of the dryer struck her leg, causing contusion of the lower leg with resulting reflex sympathetic dystrophy (complex regional pain syndrome) of the lower extremity.

2005 CASES:

$3 Million settlement during trial for catastrophic injuries for medical malpractice for 73-year old patient who was undergoing routine bypass surgery but was given blood transfusion with the wrong blood type, and suffered renal failure and below-knee leg amputation.

$2.21 Million settlement during trial for catastrophic injuries for premises liability for 25-year old woman working as live-in nanny who was exposed to toxic acetone fumes when employer's home was cleaned (without her knowledge) to remove paint. She suffered toxic demyelination of the brain.

$1.25 Million settlement for construction accident for 46-year old electrician who fell through unguarded floor opening and suffered head injury with subdural hematoma.

$1.2 Million settlement for construction accident for 50-year old electrician with pre-existing, degenerative arthritis in both knees, who tripped and fell due to floor opening, and suffered knee injury with resulting knee replacement.

$800,000 settlement for construction accident for 33-year old ceramic tile laborer who tripped on debris and fell into foundation ditch, with his knee striking a pipe. He suffered torn medial meniscus and torn anterior cruciate ligament that eventually required knee replacement.

$800,000 settlement during trial for construction accident for 40-year old electrician who fell from ladder and suffered fractures of right clavicle and right wrist and low back injury (all without surgery).

$790,000 settlement during trial for motor vehicle accident for 34-year old pedestrian who was struck by a vehicle that backed up unsafely, with knee injury requiring arthroscopic surgery, and with neck and low back injuries, with herniated discs and radiculopathy (without surgery).

$750,000 settlement for construction accident for 40-year old electrician who fell from catwalk in AMTRAK tunnel to tracks below with resulting back injury (no surgery), but risk of future spinal fusion.

$750,000 settlement for construction accident for 49-year old electrician who tripped and fell on debris on stairs and suffered knee injury with torn medial and lateral menisci.

$590,000 settlement for construction accident for 34-year old electrician who fell from ladder and suffered low back injury with herniated disc at L5-S1.

$500,000 settlement for medical malpractice for 59-year old woman who was being treated for diabetes, high blood pressure and renal failure, and suffered nerve damage of the left (non-dominant) arm during vein arterial graft for dialysis.

$500,000 settlement for premises liability for woman who slipped and fell on oil in elevator which had been applied to the walls of the elevator to remove graffiti. She suffered herniated disc at L4-5 requiring surgery for fusion.

$500,000 settlement for motor vehicle accident for 46-year old pedestrian struck by vehicle, who suffered fracture of the distal femur and tear of the labrum of her left hip (without surgery).

$500,000 settlement for motor vehicle accident for 25-year old passenger in motor vehicle (who was not wearing seat belt), who suffered fractured arm which required surgery with open reduction and internal fixation.

$450,000 settlement for construction accident for 50-year old boilermaker who tripped on ground cable and suffered fractured kneecap (patella) requiring surgery.

2004 CASES:

$2.5 Million settlement for construction accident for 37-year old carpenter foreman who was injured while supervising delivery of heavy material at construction site, where his employer was using backhoe to unload materials when they shifted and started to fall; and he jumped off the truck to avoid being struck by the falling load and injured his knee. We successfully argued that the defendants had violated the Industrial Code regulations regarding the use of material hoists. He suffered torn medial meniscus and anterior cruciate ligament tear requiring two arthroscopic knee reconstruction procedures and developed chronic low back injury due to his impaired gait.

$2.5 Million settlement for construction accident for 28-year old electrician who fell from ladder and suffered compound fracture of the L1 vertebra requiring surgery to replace vertebra with a rib, and crushed wrist requiring surgery with open reduction and internal fixation.

$1.75 Million settlement for motor vehicle accident for 72-year old motorist who suffered fractured cervical vertebrae requiring cervical fusion and fractured hip requiring surgery with open reduction and internal fixation, who claimed that the defendant's vehicle was speeding around a blind curve into the intersection; and the defendant argued that our client failed to obey a stop sign before entering the intersection.

$1.6 Million settlement for construction accident for 38-year old electrician who slipped and fell on debris on stairway with resulting cervical herniated disc and aggravation of pre-existing arthritic changes.

$1.5 Million settlement for construction accident for electrician who slipped on debris on stairway and injured his lower back, with herniated disc and lumbosacral radiculopathy requiring spinal epidural injections.

$825,000 settlement for construction accident for 44-year old electrician who fell from ladder with comminuted fracture of the right wrist that required surgery with open reduction and internal fixation with insertion of plate and screws, and second operation to remove two screws and file the remaining plate.

$650,000 settlement for premises liability for 50-year old tenant who fell entering elevator in his apartment building that was misleveled, and suffered injuries to the neck and back. He required two laminectomy/fusion operations for the lumbosacral spine; but defendants argued that his surgery was due to serious motor vehicle accident that occurred six years earlier.

$600,000 settlement for construction accident for 46-year old electrician who fell through inadequately guarded opening in basement to bottom of shaftway with multiple soft tissue injuries including his neck, low back and shoulder (no surgery).

2003 CASES:

$1.6 Million settlement for construction accident for 43-year old elevator mechanic/foreman who injured left knee on construction project while attempting to bring old elevator part on dolly down ramp, which was slippery due to sand and other debris. He slipped and blew out his knee while attempting to hold on to the heavy load. His injury required several knee operations.

$705,000 settlement for construction accident for 34-year old laborer who was installing drainage pipe in excavation trench that collapsed, causing him to suffer broken ribs, back injury requiring epidural nerve block, and knee injury requiring Synvisc steroid injections.

$650,000 settlement for premises liability for 49-year old electrician who slipped and fell on water that dripped from ice being delivered to food vendors at Convention Center where he was employed. He suffered left knee injury requiring arthroscopic surgery for torn cartilage and aggravation of prior back injury due to his altered gait.

$625,000 settlement for construction accident for 50-year old electrician who fell off ladder with fracture of the right wrist and with soft tissue injuries to his right elbow, right shoulder, neck, back and right knee.

$450,000 settlement for construction accident for 53-year old electrician working on an 8 foot ladder. The ladder tipped and he injured his wrist while trying to prevent himself from falling, requiring surgery for his soft tissue wrist injury.

$420,000 settlement for construction accident for 40-year old electrician who slipped and fell on stairway due to debris and suffered low back injury with herniated disc at L5-S1 (no surgery).

2002 CASES:

$3.7 Million settlement (after $4.9 Million jury verdict) for construction accident for 33-year old electrician who fell from 6 foot ladder and suffered severe impingement syndrome of right (dominant) shoulder, biceps tendinitis with recurrent right shoulder dislocation, and torn rotator cuff that required arthroscopic surgery.

$2.5 Million settlement for construction accident for 40-year old construction worker who fell from ladder and suffered bimalleolar fracture of the right ankle requiring open reduction and internal fixation.

$2.375 Million settlement for construction accident for 44-year old laborer working on job site who was struck in back by manlift operated by another trade, with neck injury requiring cervical fusion, and with low back sprain and shoulder tendinitis.

$2 Million settlement for medical malpractice for 16-year old victim of knife attack, where the hospital failed to detect and treat a hole in his intestine, which resulted in feces getting into his lungs.

$1.75 Million settlement for construction accident for 26-year old construction worker who fell through opening in roof and fractured his wrist, requiring surgery with open reduction and internal fixation, external fixation device, and eventual fusion.

$1.3 Million settlement for construction accident for 29-year old electrician who fell while climbing off ladder when he stepped on debris on the floor, and suffered a fractured ankle with two surgeries followed by ankle fusion.

$1.3 Million settlement for construction accident for 51-year old electrician who fell from ladder and suffered multiple herniations of the cervical, thoracic and lumbar spine (all without surgery), along with laceration of the palm of his hand which required sutures.

$900,000 settlement for construction accident for 31-year old electrician who fell through ceiling and suffered fracture of the left humerus with open reduction and internal fixation, right knee sprain with arthroscopic surgery, and low back sprain (no surgery).

$700,000 settlement for construction accident for 57-year old electrician who tripped over door buck (outside frame of door) that was lying on the floor and suffered right knee injury with two arthroscopic surgeries followed by total knee replacement (which defendants claimed was all due to pre-existing arthritis).

$650,000 settlement for construction accident for 32-year old construction worker who fell from a scaffold and suffered neck and back injuries with herniated/bulging discs and radiculopathy (no surgery), as well as partial tear of the right quadriceps (no surgery).

$600,000 settlement for construction accident for 39-year old electrician who tripped on extension cord on stairs and suffered quadriceps tear, knee injury with tear of medial meniscus, and low back injury with exacerbation of previous degenerative disc changes.

$600,000 settlement for construction accident for 54-year old laborer foreman on construction project to refurbish an old bridge, who suffered crush injury of the foot with multiple fractures requiring surgery with open reduction and internal fixation, when the operating engineer who was moving a heavy Jersey barrier with a backhoe failed to hoist it in conformity with the Industrial Code. Although the lower court dismissed this case, we were successful on appeal in reversing that decision and reinstating the lawsuit.

$525,000 settlement after successful trial verdict for construction accident for 56-year old electrician who tripped and fell due to raised computer floor panel with resulting low back sprain and disc bulge at L5-S1 (no surgery).

$475,000 settlement (with defendants paying $375,000 over their $100,000 insurance policy) for motor vehicle accident for 32-year old motorist whose car was struck by the defendants' vehicle that disobeyed a stop sign, and injured her left knee, neck, low back and shoulder.

$450,000 settlement for construction accident for 59-year old worker who was painting New York City traffic lights and became concerned that elevated basket of bucket-truck in which he was working might be unstable and attempted to climb from the basket to the freshly painted traffic light. He fell and suffered multiple fractures, including left arm (requiring surgery with open reduction and internal fixation), left hip and pelvis.

2001 CASES:

$4 Million settlement for catastrophic injuries in construction accident for 48-year old electrician who fell 40 feet through sheetrock that covered top of elevator shaftway and landed on top of the elevator car. He suffered severe internal injuries, including massive abdominal hemorrhage and ruptured pancreas, burst fracture of T-10 vertebra, and crush injuries of the right ankle and right hand; and he died 12 days later.
