No laughing matter: Tracy Morgan files truck accident lawsuit

Serious matters require a serious approach. That’s the mode comic Tracy Morgan is in these days after sustaining “severe painful bodily injuries” after the New York City native was involved in a June 7 truck accident that left another man dead.

Morgan and his attorney recently filed a lawsuit in U.S. District Court against Walmart, alleging that the company is responsible for the crash involving its truck and driver. The driver of the 18-wheeler that hit Morgan’s limo had reportedly been “awake for more than 24 consecutive hours” before the collision.

In court documents, Morgan states that his injuries included, but were “not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”

The 35-year-old trucker had driven from his Georgia home to a Walmart distribution center in Delaware – a trip of more than 700 miles – before he even began his shift, according to the lawsuit. He then spent an additional 9 hours and 37 minutes of straight driving on the clock for Walmart before his big rig slammed into Morgan’s limo van, injuring the “30 Rock” star and four others, and killing an occupant of the smaller vehicle. The 18-wheeler was reportedly going 65 mph in a 45 mph zone when it struck the van from behind.

Morgan was in critical condition after the crash, with injuries that included broken ribs and a broken leg.

Comedian James McNair, 63, was killed in the collision that flipped the limo onto its side. The truck driver has pleaded not guilty to criminal charges stemming from the New Jersey Turnpike crash.
